The product, hereby referred to as the software, is subject to the following end user license agreement, hereby referred to as the EULA.
Disclaimer of warranty:
This software is provided "as is" and use of the software is at your own risk. eXaltic disclaims any and all warranties, whether express, implied or statutory, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose or non-infringement of third-party rights. eXaltic does not warrant that the software is free of defects and shall not be obliged to fix them.Terms in this Agreement excluding or limiting liability in relation to breach of the terms implied by the "Supply of Goods (Implied Terms) Act 1973 or the Sale of Goods Act 1979 do not apply when this Agreement is made with a consumer.
License agreement:
The EULA grants the license holder, you, a non-exclusive license to use the software on one installation, accessible by one URL, for each licensed purchased; in accordance with the following terms and conditions.You may do the following:
- Modify or customise the software to your personal needs, in accordance to this agreement.
- Use the software for activities that are lawful and just.
You may not do the following:
- Use the software in a way that falsely displays the product or eXaltic.
- Remove, modify or hide any internal links, promotions or developer details provided within the product that show eXaltic as the originator of the product.
- Make copies of, distribute, leak or disclose the software's source code.
- Use the software in such as way as to condone or encourage illegal or un-just activities.
- Use the software in conjunction with pirated or illegal software.
- Share user account information to allow others to download software from the eXaltic, or any affiliated, websites (see Appendix 1).
- Rent, lease, sublicense, sell, assign, pledge or transfer the software or its license in any form, on a temporary or permanent basis, without the prior written consent of eXaltic.
Appendix 1:
Accounts that have logins from multiple IP addresses in a short time frame may be deemed as compromised and
may be subject to review and possible cancellation by management. Users will be notified before any action is
taken.
